What types of licenses and permits would I need for an at home personal training gym in Houston, TX?

I’ve worked as a personal trainer for over 4 years at a franchise gym. I’ve had many clients and people ask me throughout my time there if I’d be ever be interested in training and teaching outside of the gym. I’ve recently looked into setting up my garage into a small gym. I’m taking all the precautions necessary to ensure a safe environment with the building structure, equipment, and I’m even installing rubber matting all along the floor. I have been looking for information on permits and licenses required for me to have this up and running legally in my home. I am certified through three different organizations as well as CPR certified. What would my next steps be to ensure that I have no problems with the IRS or local law in the future once I get this started? Thanks in advance!

You won’t be able to do this unless your property is restriction-free, meaning you can have a home-based business without violating any community deed restrictions. Many areas of town have homeowner’s associations that enforce these restrictions and you might get sued if you are caught running a business out of your home.

More importantly you’ll need commercial liability insurance. You will also need a DBA (Doing Business As) certificate and a state sales tax certificate.

My advice, apply for a small business loan and operate your business in a storefront. You really don’t want your clients knowing where you live, and establish your business as a Limited Liability Company (LLC) to protect your personal assets in case someone decides to sue you. Look for an attorney you can place on retainer who can assist you with all of the legal stuff.

    Deed restrictions do not issue permits for this in home. The only permit for homes is Day care.
